Terms of Service for Oigo

Effective date: 5 November 2026

These Terms of Service (“Terms”) govern your use of the Android app Oigo (package ch.castellon.oigo, “the App”). The App is provided by Antonio Castellon, trading as Castellon.CH, Biel/Bienne, Switzerland (“we”, “us”). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. What the App is

Oigo is a hands-free voice assistant for Android. You press Listen (or use a wake phrase), speak a request, and the App uses your own xAI / Grok account to obtain an answer and speak it aloud. Optional features include notes, alarms, calling a contact, and reading WhatsApp or Telegram notifications after you confirm.

Oigo is an independent product. It is not made, endorsed, sponsored, or affiliated with xAI or Grok. “Grok” and “xAI” are trademarks of their respective owners.

2. Licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and use the App on devices you own or control, for your own non-commercial use, under these Terms. You may not copy, reverse-engineer (except where mandatory law allows), redistribute, rent, or sublicense the App, or remove any notices from it.

3. Your account and third-party services

To get answers, you need your own xAI account and credentials (an API key from console.x.ai, or the optional SuperGrok sign-in if available). Usage and any charges are billed by xAI to you under xAI’s terms, not ours. We do not sell xAI access and we do not receive your conversations.

Speech recognition and text-to-speech use the services built into your phone (often Google’s). Optional features may open the phone dialer, WhatsApp, or similar apps you already have. Those services have their own terms and privacy policies. We are not responsible for them.

4. Your responsibilities

5. Free app; no ads

The App is free to download from Google Play. We do not show ads in the App. Any cost of using xAI is between you and xAI.

6. Privacy

How the App handles information is described in the Privacy Policy: https://www.castellon.ch/oigo.privacy. That policy forms part of these Terms.

7. Availability and changes

We may update, suspend, or discontinue the App or any feature at any time. xAI may change or withdraw APIs or sign-in methods; if that happens, parts of the App may stop working until we adapt them. We will try to keep the App working, but we do not guarantee uninterrupted or error-free service.

We may change these Terms by publishing a new version at this URL and updating the effective date. Continued use after the change means you accept the new Terms.

8. Disclaimer of warranties

The App is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by Swiss law. We do not warrant that answers from third-party AI will be accurate, safe, or suitable for your needs.

9. Limitation of liability

To the fullest extent permitted by Swiss law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of data, profits, or business, arising from your use of (or inability to use) the App or from third-party services it relies on. Our total liability for any claim relating to the App is limited to CHF 0 (zero), because the App is free. Nothing in these Terms limits liability that cannot be limited under mandatory Swiss law (for example for intentional misconduct or gross negligence, or for death or personal injury caused by negligence where such a limit is void).

10. Termination

You may stop using the App at any time by uninstalling it. We may end your licence if you breach these Terms. On termination, you must stop using the App and uninstall it. Sections that by nature should survive (including disclaimer, limitation of liability, and governing law) continue to apply.

11. Governing law

These Terms are governed by the laws of Switzerland, without regard to conflict-of-law rules. Courts of Biel/Bienne (Bienne), Canton of Bern, Switzerland, have exclusive jurisdiction, unless mandatory consumer-protection rules where you live give you the right to sue in another court.
